    • John King Tucker was charged by Inspector
      Houlgrave, of the State Children's Department, with non-fulfilment of an order for maintenance, made against him on May 10, for the support of his wife and children. The arrears on August Í amounted to £10 10/. The accused did not appear and was sentenced to one month's imprisonment. [1]

      Mr. Lathlean, for the petitioner, said the case was heard by Mr. Justice Gordon on May 2. He moved for a decree nisi, with

      costs.

      Mr. Justice Gordon reported the charge of desertion and adultery proved. Although the marriage was contracted and the matrimonial offences were committed outside the jurisdiction of the court, he found that the parties were domiciled within jurisdiction at the time proceedings were taken.

      A decree nisi, with costs against the husband, was granted, and an order was made for the wife to have the custody of the

    • Tucker versus Tucker.

      Susan Etheleen Priscilla Tucker petition-

      ed for a divorce from her husband, John King Tucker, on the grounds of adultery and desertion. Mr. R. H. Lathlean ap- peared for the petitioner, and there was no appearance on behalf of the respondent.

      The facts of the case, as given in evi dence, were that the parties were married at Broken Hll on October 21, 1897. The re- spondent was then representing Singer and Co, of Adelaide. They lived at Broken Hill for three months, when the respondeat left for Adelaide. He returned in two months' time and stated that he had been engaged to canvass for Wertheim & Co., still at Bro- ken Hill. After seven months' work at Broken Hill the respondent took the peti- tioner to Adelaide, where he obtained em- ployment with Dimond Brothers. Shortly afterwards he got into trouble and served a term in prison. On his release some friends started the respondent in a hairdresser's business at Port Pirie. There were two children of the marriage, and the family lived at Port Pirie for about seven months. In January, 1902, the respondent suddenly left Port Pirie without saying anything to the petitioner. He took £5 out of the till and left 4d. behind. The petitioner tried to keep the business going, but failed to do so; and some friends paid her fare to Ade- laide, where she had supported her chil- dren ever since. The petitioner had receiv- ed no money whatever from the respondent since he left Port Pirie. In February, 1904, the petitioner obtained the respondents address and wrote to him asking for main- tenance. In reply, the respondent wrote to the effect that he had been living with a Frenchwoman and could not assist her. He further stated that he was going to South Africa. In a subsequent letter the respondent again admitted his misconduct.

      His Honor said he would report to the court that the allegations in the petition had been proved. [3]
